My son has purchased an apartment in a gated community. I would like clarity on the following points:

1. Is it necessary to obtain patta for UDS?

2. Will an individual patta be issued or a group patta?

3. The builder is yet to sell a few more units. If a group patta has to be obtained, can we wait till all the units are sold ?

4. To apply for the patta, can we submit the Form 6 along with other necessary documents to the sub-resistrar or do we have to re-submit them to the tahsildar?

Individual patta is not applicable for undivided share of land. However, a joint patta can be obtained in the names of all the owners of undivided shares of land once the project and sale gets completed. Patta transfer forms are not insisted upon while dealing with undivided shares of land and flats.

My land document registered in the year 1996 has typographical errors in the schedule. The boundary measurements and boundary neighbours are wrongly mentioned.

Given this situation, if I apply for a patta, can the tahsildar reject my online patta application due to the error in the document boundaries? The land was allotted in 1996 but it was vacant until now and is in our possession (no encroachment). This is the first time we are applying for the patta.

The nature and severity of theerrors in the document have to be looked at in order to ascertain whether they impact your title. Notwithstanding this, you may apply for a patta and check the response from the concerned authority.
